Abstract

The purpose of this paper is to analyze the judgments of the Spanish Constitutional Court issued on the occasion of the states of alarm during the COVID-19
crisis and try to justify that the Spanish Constitution of 1978 contains five constitutional guarantees in states of emergency. Respect for these guarantees must be a priority in the interpretation and application of the regulations governing the states of emergency. These five guarantees are contained in arts. 55.1 and 116 CE and, are revealed in the rulings of the Constitutional Court on the states of alarm.
