Abstract

This paper analyses how the CJEU has developed a new interpretation ofarticle 19.1 TEU, that allows him to assert his jurisdiction over national legislation
on judicial matters. According to this ground-breaking case-law, judicial matters fall within the jurisdiction of the Court because they do not only refer to national judges, but also to European judges. In addition, the CJEU has gone one step further by starting to delineate and develop the legal status of the members of the European Judiciary, in which the principle of judicial independence plays a crucial role.
