The legal inclusion of the universal framework for the protection of social rights within the Spanish legal system

Abstract

This paper analyzes how the universal framework for the protection of social rights, and especially of its individual communications mechanism, fits within the Spanish legal system. To this end, the focus is both on the legal nature of its supervisory body, the Committee on Economic, Social and Cultural Rights, and on the effectiveness of its resolutions. Moreover, following a decision declaring a violation of the right to housing by Spain, the paper explores the limits of the conventionality control in this matter and the possible effects of the hermeneutical mandate contained in art. 10.2 CE upon the guiding principles of the social and economic policy.
