Abstract

The controversial Law 4/2015 of protection of citizen security has finalized a reform of the Spanish penal law and sanctioning system and that, overall, has had a fierce response from various doctrinal and political sectors and social activism. Certainly, citizen security model drawn by the Law is ostensibly way and that its object and purpose aimed at containment of disruptive behaviors of certain social sectors. In this paper, therefore, we will take the exam LOPSC from some of the limitations introduced in the availability of public space for the exercise of the right of political participation. In that sense we can move to the diction of some of the punishable types is difficult to reconcile the consolidated constitutional jurisprudence.
