The Constitutional Court in a pluri-national State: Bolivia’s constitutional challenge

Abstract

Bolivia faces the challenge of building up a Plurinational State in accordance with the rules established by her brand new 2009 Constitution. For this purpose, the Plurinational Constitutional Court may become a key device since it is the only domestic jurisdictional body placed upon both the state judicial system and the judicial system of indigenous peoples. Such a constitutional approach is unique in the Latin American region. This paper reviews the constitutional jurisprudence among Latin American States in search of possible guidelines. Only Colombia offers a significant piece of jurisdictional practice that may lend a hand in this regard. As for the rest of feasible options, the Plurinational Constitutional Court of Bolivia actually faces an unprecedented challenge.
