The binding effects of Constitutional Court sentences on the legislative: Can the legislative reiterate legal precepts previously declared unconstitutional?

Abstract

This article analyses the binding effects of the ruling of the Constitutional Courts and, more precisely, whether the legislator can reiterate legal provisions that have been declared unconstitutional. It shows the lack of a minimally shared position amongst the authors and analyses the dangers of a negative answer to the question formulated and also the comparative law on this subject. The author defends the thesis that, given certain conditions —which are analyzed—, it cannot be concluded that the binding effects of the constitutional rulings on the legislator prevent him from reiterating the provisions declared unconstitutional. The case of the Statute of Autonomy of Catalonia of 2006 serves as a contrast to the discussion contained in the work.
