Abstract

The victims of crime suffer an aggravated injury on their rights when the treatment given by the press to the facts is not appropriate. Even when the transmission of information concerning a judicial process meets the strict rules of veracity and public relevance, the news can cause damage to rights as privacy, honor, safety, etc. This essay uses the rule of rights balancing to analyze, in both cases, the established limits to freedom of information about a judicial process. And it shows that we cannot even talk about balancing when the right to inform has been used without limits or restraint.
