Abstract

Human history is full of catastrophes, including epidemics and pandemics. In order to deal with these crisis situations, we jurists have devised a law of necessity that has its own profiles, which are analysed in this article.
The latest great global catastrophe to hit our planet was the pandemic caused by Covid-19. This extreme public health crisis has led to the activation of the law of necessity all over the world and, of course, also in our country. The implementation of the constitutional state of alarm and ordinary health legislation has revealed significant problems, which, according to the author, demonstrate the imperative need to readjust the Law of Necessity in Spain in order to fight against the major public health crises that may devastate us in the future.
