Abstract

In this work, an analysis of some problematic aspects of Order 177/2022, of December 19 of the Constitutional Court, is carried out in comparison with the provisions of the German Federal Constitutional Court in its Resolution of July 5, 2023. In both resolutions order the suspension of an ongoing legislative procedure, based on similar reasoning, which has not been without controversy in either country. Some of the problems that these orders pose for the legislative function, parliamentary autonomy and the role of the Constitutional Court itself in amparo procedures are analyzed.
