Trans people and no binary people’s rights in the Colombian Constitutional Court and Inter American Human Rights System case law

Abstract

This contribution presents a balance of the way in which the guarantee and protection of the political rights of trans and non-binary persons is outlined in the Colombian constitutional jurisprudence and in the jurisprudence of the Inter-
American Court of Human Rights. Thus, based on a general review of the main judgments handed down by both courts in which the situation of trans and non-
binary persons is addressed in some way, it is concluded that there is still a long way to go insofar as there is still no protection of their political rights, but only the protection of the preliminary elements necessary for the exercise of such rights has been achieved.
