Vulnerability against housing evictions as a constitutional trend

Abstract

The Spanish Act 12/2023 of the 24th of May, Act for a right to housing, establishes how a factor of special vulnerability would trigger specific mechanisms to protect people in such a situation. Among those mechanisms, those affecting judicial proceedings related to housing evictions are especially relevant. New measures, no longer linked to financial or pandemic crisis, stand by their own as social rights protection measures, all because of trends of constitutional interpretation enhancing right to housing effectiveness. This work presents a study of the legal hermeneutics that, coming from Constitutional, Human Rights and European Union Law interpretation, have reinforced those trends during the past decade. The conclusion evaluates how such trends impact on writs of possession.
