Abstract

This paper explains the relevance of the ECJ (First Chamber) Judgment of 26 March 2020, case C-2/19, for the mutual recognition of decisions on the suspension of the enforcement of custodial sentences, which impose no other condition than that of not committing any further offences during the period of suspension. In addition, it proposes the application of this to other conditions not expressly mentioned in Framework Decision 2008/947/JHA, such as the payment of fines or civil liability and compliance with the terms agreed in a mediation process, among others.
