Abstract

This article proposes some reflections from two key elements of analysis: As a starting point, the figures about Turkey included in the latest Annual Report of the European Court of Human Rights. Second, some of the key aspects of the last judgments of the ECtHR in which Turkey has been condemned for violation of the article 3 of the European Convention of Human Rights: the cases Getiren v. Turkey, Kemal Kahraman v. Turkey and Osman Karademir v. Turkey, as well as two cases of ends of 2007 - beginning of 2008, the cases Osmanoçlu v. Turkey and Balçik and others v. Turkey. To this end, the article will present an initial comment of the Annual Report´s figures, and a study of both the facts of cases and the conclusions reached by the ECtHR, focusing on this work to the common ground that could show the continuation, or termination, of a guideline in the behavior of the state of Turkey. All this will be seen in a wider context, in which some final thoughts will be presented on the possible adhesion of Turkey to the European Union in view of it respect of the article 3 of the ECHR.
