Abstract

This article presents the contents of the Directive 2009/71/Euratom, on Nuclear Safety, explaining its legal basis and its relationship with the Convention on Nuclear Safety. To put into context the Directive, the author refers briefly the experience of the failed «nuclear package.» On the one hand, the contributions of this Directive are evaluated as compared to the Convention, while noting that the outcome has been less ambitious than originally intended in the nuclear package. On the other hand, the author questions the effectiveness of the mechanism for evaluating compliance with the Directive, based on selfassessments and peer reviews.
