Abstract

The present paper analyzes in a critical way the conceptualization of human embryo in the Law of the Union introduced by the judgement of the Court of Justice of 18 October 2011 in the Case C 34/10. It is criticized as a bad-aimed step in the wrong direction because it unreasonably would expand the ratio decidendi of the European Patent Office (EBoA) Decision of 25 November 2008 in the WARF case, and because it unjustifiably would ignore the Opinions of the EGE and the jurisprudence of the European Court of Human Rights.
