Abstract

The Spanish Constitutional Court has recently issued several judgments related to the protection of sexual and reproductive rights (Judgments 66/2022, of June 2; 11/2023 of February 23; 44/2023 of May 9; and 78/2023 of July 3) pointing out that a doctrinal change is needed in line with the evolution of judicial instruments for the protection of women’s rights. Nevertheless, the Court’s opinion faces multiple limitations and therefore it is necessary the strengthen of perspectives which reinforce the interpretation of sexual and reproductive rights in terms of equality.
