The proposal to reform sexual offences contained in the draft Organic Law on the Comprehensive Guarantee of Sexual Freedom, which is currently being processed by Parliament, has been received in a disparate manner. Within it there is an overlap of planes between the right to sexual freedom as well as its guarantee and its exercise, so that everything that does not have to do with the exercise of sexual freedom, should be left out. In particular, this paper analyzes the reasons for the change in the regulation of crimes of sexual assault and abuse, as well as the nonsense that may be eclipsing the true entity of the model of legislative intervention that encloses beyond protection, the guarantee of sexual freedom.
