OTRA REFORMA LABORAL MÁS

Resumen

Se analiza en el presente estudio la última de las reformas laborales, introducida este año 2010. Se enmarca dicha reforma en el proceso de sucesivos cambios en la legislación laboral que desde 1980 se vienen produciendo.

Se analizan las razones de esa reforma y los problemas estructurales y coyunturales del mercado de trabajo español más directamente relacionados con el ámbito laboral, así como los posibles cambios que realmente era necesarios en la regulación laboral.

El trabajo concluye con una valoración negativa de la reforma laboral, entendiendo que por un lado no resuelve los problemas de la mayor parte de los empleadores españoles, que son pequeñas empresas, incluso muchas veces microempresas de muy pocos trabajadores; y que, por otro, ha reducido considerablemente los derechos laborales sin que exista ninguna garantía de que esa reducción permita crear empleo y, sobre todo, permita crear empleo de mayor calidad.

This paper analyzes the last reform on labour law, introduced this year 2010. This reform is one of the stages in the ongoing process of changes in labour law, which is taking place since 1980.

The paper analyzes the reasons for such a reform and the structural and temporary problems of the Spanish labour market more directly related to the workplace, as well as the possible changes that were really needed in labour regulation.

The paper concludes with a negative assessment of the labour reform, arguing on the one hand that it does not solve the problems of most Spanish employers, which are small undertakings, very often even micro enterprises very few workers; and, on the other, that it has significantly reduced labor rights without any guarantee that this reduction will allow the creation of employment, specially of higher quality jobs.
