Activismo judicial del TEDH y el TJUE frente a la violencia contra las mujeres en Europa

Pese a las dificultades que sigue planteando disponer de datos sobre el alcance de la violencia contra las mujeres en el conjunto del espacio regional europeo, la información existente revela que dicha violencia sigue siendo prevalente y grave, y que en muchos casos queda sin denunciar. En este contexto, este artículo se propone analizar la respuesta del Tribunal Europeo de Derechos Humanos (TEDH) y del Tribunal de Justicia de la Unión Europea (TJUE) ante las tendencias regresivas en materia de género en Europa. Partiendo de los datos que evidencian el alcance de la violencia contra las mujeres en la región, se examina la jurisprudencia más reciente de cada uno de estos tribunales, como dos respuestas autónomas –pero coincidentes– en la reafirmación del marco normativo internacional y regional en la materia, estableciendo sus puntos de conexión y complementariedad.
