Análisis contrastivo de la demanda o <em>claim</em> como tipo textual

Resumen

La finalidad del presente trabajo es analizar el género jurídico de la demanda o claim atendiendo principalmente a las similitudes o diferencias de carácter lingüístico de este tipo textual en el ordenamiento jurídico español e inglés. Para ello, intentaremos describir y ubicar dicho género en el procedimiento en ambos sistemas, determinaremos su función comunicativa y su finalidad jurídica, identificaremos las partes o secciones de este tipo textual y, por último, describiremos sus características léxicas y otros rasgos lingüísticos destacables. Es también esencial, a la hora de realizar dicho análisis contrastivo, determinar en qué medida los términos demanda y claim son equivalentes y si, por tanto, representan un mismo concepto jurídico. De no ser así, tendremos que establecer qué características o rasgos semánticos definen ambos conceptos. Palabras clave: demanda, tipo textual, género, sistemas jurídicos, equivalencia. Abstract A contrastive study of demanda and claim as a text type Kenneth JORDAN NÚÑEZ The aim of this project is to analyze demanda or claim as a legal text type, focusing mainly on their linguistic similarities and differences within both the Spanish and the English legal codes. With that purpose, we will try to describe and locate this text type within the proceedings of both systems, establish its communicative function and its legal purpose, identify its sections and, finally, describe its lexical characteristics and some other relevant linguistic features. It is also essential for carrying out this contrastive study to determine the degree to which the terms demanda and claim are equivalent and, then, whether they represent the same legal concept. If not, we will have to establish which characteristics or features define each concept. Key words: claim, text type, equivalence, legal system.
